These Terms & Conditions govern the use of the NIKTravels.com portal by Hosts (Service Providers) and Visitors (Users). By accessing or using the platform, all parties agree to comply with and be bound by the terms outlined below.

1. Definitions

“Platform” refers to the NIKTravels.com website and its associated services.
“Host” or “Service Provider” refers to any individual or business that registers a profile and publishes listings for accommodations, experiences, excursions, tours, or itineraries.
“Visitor” or “User” refers to any individual browsing, searching, or booking services through the platform.
“Listing” refers to any accommodation, experience, excursion, or itinerary published by a Host.
“Booking” refers to a reservation or purchase made by a Visitor directly with a Host.

2. Role of NIK Travels

NIK Travels operates as a vacation advisory and host‑listing platform. The platform:

Provides visibility for Hosts and their services.
Allows Visitors to search, compare, and request bookings.
Facilitates communication between Hosts and Visitors.

NIK Travels is not the provider of the listed services. All services are operated, fulfilled, and managed exclusively by the Host.

3. Host Responsibilities

By registering as a Host, you agree to the following:

Hosts are solely responsible for:

The accuracy, legality, and completeness of all content posted under their profile.
Providing truthful descriptions, pricing, availability, images, and service details.
Ensuring that all information remains up to date.

3.2 Service Fulfillment

Hosts are fully responsible for:

Delivering the services exactly as described in their listings.
Meeting all local, regional, and national legal requirements.
Ensuring safety, quality, and compliance with applicable regulations.

3.3 Payment Terms

Hosts may define their own payment terms, cancellation policies, and service conditions.
Visitors must review and accept these terms before completing a booking.
Hosts are responsible for communicating payment instructions and issuing confirmations.

3.4 Liability

NIK Travels is not liable for:

Service delivery failures.
Misrepresentation by Hosts.
Financial transactions between Hosts and Visitors.

Hosts agree to indemnify NIK Travels against any claims arising from their listings or services.

4. Visitor Responsibilities

Visitors using the platform agree to:

Use the platform as a vacation advisory and booking tool.
Review all Host-provided terms, conditions, and payment policies before booking.

4.2 Direct Agreements with Hosts

All bookings constitute a direct agreement between the Visitor and the Host.
Visitors must comply with the Host’s payment terms, cancellation rules, and service conditions.

4.3 Conduct

Visitors agree not to:

Misuse the platform.
Provide false information.
Engage in fraudulent booking behavior.

5. Platform Usage Rules

5.1 Account Registration

Hosts must register a profile to publish listings.
Visitors may browse freely but may need to provide contact details to request bookings.

5.2 Prohibited Activities

Users may not:

Post unlawful, misleading, or harmful content.
Attempt to bypass platform security.
Use the platform for unauthorized commercial purposes.

6. Payments and Financial Transactions

NIK Travels may process cardholder data and payments using authorized POS platforms such as Chase Business Banking and Square POS in specific situations.
In limited cases, NIK Travels enables Visitors to purchase certain services directly through the platform based on service agreements with Hosts.
Payment processing by NIK Travels is conducted under applicable PCI compliance and merchant account agreements.
Hosts and Visitors acknowledge and agree that NIK Travels acts as a payment processor only for specific services and transactions as explicitly arranged.
All other financial transactions remain direct agreements between Hosts and Visitors.
NIK Travels is not responsible for refunds, disputes, or chargebacks except as outlined in specific payment processing agreements.
NIK Travels ensures secure handling of cardholder data in accordance with applicable data protection laws and standards.

6.1 Payment Processing Disclosures

By using the platform, Hosts and Visitors acknowledge and consent that NIK Travels may act as a payment processor for certain transactions.
Payment processing is facilitated through authorized third-party POS platforms, including Chase Business Banking and Square POS.
NIK Travels does not store full cardholder data and complies with PCI DSS requirements to ensure secure payment handling.
Users agree to provide accurate payment information and authorize NIK Travels to process payments as necessary for the services purchased.
Any fees, refunds, or disputes related to payments processed by NIK Travels will be handled according to the specific terms outlined in the service agreements and payment policies.

6.2 User Acceptance of Payment Terms

Prior to completing any payment on the platform, Visitors and Hosts will be presented with the applicable Terms & Conditions, including payment processing disclosures.
Users must explicitly agree to these terms by checking an acceptance box or similar mechanism before proceeding with payment.

The duration of the subscription and its expiration date.

Subscription plans may vary by region, category, or promotional period. Details of each plan are available on the Host dashboard or upon request.

7.2 Listing Limits

Each subscription plan specifies the maximum number of listings a Host may publish under their profile. Hosts agree to:

Publish only the number of listings allowed under their active plan.
Upgrade their subscription if they wish to publish additional listings.
Remove or archive listings if they exceed the permitted limit.

NIK Travels reserves the right to temporarily hide or deactivate listings that exceed the Host’s plan limits.

7.3 Subscription Expiration

Each subscription plan is valid until its stated expiration date.
Upon expiration, Hosts may lose access to certain features, including visibility of listings, booking tools, or promotional placements.
Hosts are responsible for renewing their subscription before expiration to avoid service interruption.
If a subscription expires, listings may be set to “inactive” until renewal is completed.

NIK Travels is not responsible for any loss of visibility or bookings resulting from expired subscriptions.

7.4 Advertising and Promotional Options

Depending on the subscription plan, Hosts may access additional advertising features, including but not limited to:

Featured placement in search results.
Highlighted listings.
Promotional banners.
Priority ranking within destination categories.
Seasonal or campaign‑based visibility boosts.

These features are subject to availability and may change over time. NIK Travels reserves the right to modify, discontinue, or replace promotional options at its discretion.

7.5 Changes to Subscription Plans

NIK Travels may update subscription tiers, pricing, listing limits, or advertising features. Any changes will be communicated through the platform or via email. Continued use of the platform after such updates constitutes acceptance of the revised terms.

8. Disclaimers

NIK Travels does not guarantee the accuracy of Host listings.
The platform is provided “as is” without warranties of any kind.
NIK Travels is not responsible for service quality, safety, or fulfillment.

9. Limitation of Liability

To the maximum extent permitted by law:

NIK Travels is not liable for any direct, indirect, incidental, or consequential damages arising from platform use.
All risks associated with booking or providing services rest solely with Hosts and Visitors.

10. Intellectual Property

Hosts retain rights to their uploaded content but grant NIK Travels a license to display it on the platform.
Visitors may not copy, reproduce, or misuse platform content.

11. Privacy and Data Use

Personal information is handled in accordance with the NIK Travels Privacy Policy.
Hosts and Visitors must comply with applicable data protection laws.

12. Modifications to Terms

NIK Travels may update these Terms & Conditions at any time. Continued use of the platform constitutes acceptance of the updated terms.

These Terms & Conditions are governed by the laws of the State of Florida, USA.
